These Terms of Service govern the relationship between MM Bay Construction & Remodeling ("MM Bay," "we," "us," or "our") and you ("client" or "you") when you request, schedule, or receive services from us. By submitting a quote request or entering into a service agreement, you agree to these terms.
MM Bay Construction & Remodeling provides custom welding, metal fabrication, metal repairs, and interior remodeling services throughout the Bay Area. The specific scope of work, materials, and deliverables for each project will be outlined in a separate written proposal or work order agreed upon by both parties before work begins.
All estimates provided by MM Bay are based on information available at the time of assessment. Final pricing may vary if:
Any changes to the original scope will be communicated in writing before additional work proceeds.
Payment terms for each project are specified in the written proposal or work order. In general:
Late payments may result in work suspension and additional fees as permitted by applicable law.
Estimated timelines are provided in good faith based on current scheduling and project scope. Timelines may be affected by weather conditions, permit processing times, material availability, or changes requested by the client. We will communicate any significant delays as soon as they are identified.
To allow work to proceed smoothly, the client agrees to:
If you need to cancel or reschedule a scheduled visit or project start, please notify us as soon as possible. Cancellations made with less than 48 hours notice may result in a cancellation fee. Any non-refundable materials already purchased for your project may be charged regardless of cancellation.
MM Bay stands behind its workmanship. Any warranty terms applicable to your project will be stated in the written proposal. This warranty covers workmanship defects and does not extend to normal wear and tear, damage caused by the client or third parties, or pre-existing conditions.
Materials are subject to the warranties provided by their respective manufacturers.
MM Bay's liability for any claim arising from services rendered shall not exceed the amount paid by the client for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages. Some jurisdictions may not allow these limitations; in such cases, liability will be limited to the extent permitted by law.
These terms are governed by the laws of the State of California. Any disputes arising from these terms or from services provided by MM Bay shall be resolved in the appropriate courts of the State of California.
We may update these Terms of Service from time to time. The current version will always be available on this page with the effective date noted at the top. Continued use of our services after updates constitutes acceptance of the revised terms.
